Reporting copyright infringement
If you believe a work on Tegata infringes your copyright, send us a notice containing the following:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed. If the notice covers multiple works, a representative list.
- Identification of the material on Tegata you claim is infringing and information sufficient for us to locate it, including the URL of the Passport or page in question.
- Your contact information: name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
DMCA agent registration is pending. For copyright concerns during the waitlist period, contact hello@tegata.us.
Notices that do not contain all six elements above may be invalid under the Digital Millennium Copyright Act and may delay our response.
False notices have legal consequences. Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing may be liable for damages.
What we do when we receive a notice
When we receive a valid notice, we will:
- Remove or disable access to the material identified in the notice, or mark the Passport disputed and pause licensing on it.
- Notify the user who posted the material.
- Provide the user a copy of the notice or its substance.
- Inform the user of their right to file a counter-notice.
Counter-notice
If your material has been removed or disabled and you believe it was removed in error or misidentification, you may send us a counter-notice containing:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, of any judicial district in which Tegata may be found, and that you will accept service of process from the person who provided the original notice or that person's agent.
Send counter-notices to hello@tegata.us.
If we receive a valid counter-notice, we will forward it to the person who sent the original notice. Unless that person notifies us within ten to fourteen business days that they have filed a court action seeking to restrain the activity, we may restore the material.
False counter-notices also have legal consequences under 17 U.S.C. § 512(f).
Repeat infringers
Tegata will, in appropriate circumstances, terminate the accounts of users who are repeat infringers of copyright. A repeat infringer is a user who has received multiple notices of claimed infringement that we have determined to be valid.
